With an incoming second Trump administration and congressional allies prepared to do his bidding, we’re braced for big fights to preserve our fundamental rights and freedoms as Americans and as LGBTQ+ people.
GLAD Law will continue working and fighting for recognition of LGBTQ+ people’s dignity and humanity, and for the safety of our communities, come what may.
We don’t know exactly what’s coming, but based on President-elect Trump’s previous administration, campaign rhetoric, and Project 2025, we expect attempts at enacting anti-LGBTQ+ laws and policies will be a prominent part of our political landscape for the foreseeable future. As a result of these discriminatory policies, people, families, and communities will struggle.
We know Trump’s playbook of division and hostility and we take it seriously. GLAD Law will use the many tools we have to challenge efforts to restrict the LGBTQ+ community’s ability to thrive and participate fully and safely in society.
We’ll use the law in every way we can to stop, slow down, and reverse policies that harm LGBTQ+ people. GLAD Law is already challenging many anti-LGBTQ+ state laws and we’re prepared to challenge federal law and policy as well — as we did with our successful lawsuit against the ban on transgender service members during the first Trump administration.
We’ll work to preserve federal-level advances, use legal and administrative mechanisms to delay harmful policies, and develop ways to reduce harm through community preparedness and state-level protections wherever possible. We’ll work proactively, with community and state partners, to advance and expand pro-LGBTQ+ policies and protections where we can.
Make no mistake, this is an all-hands-on-deck emergency. Defending our values and our democracy is not optional. Thank you for supporting and helping us in this work. Your commitment enables us to continue moving forward, regardless of any obstacles, toward a world that recognizes and protects our common dignity and humanity as LGBTQ+ people, our families, and our communities.

GLAD Law’s Annual Spirit of Justice Award Dinner took place in Boston on October 25. The evening brought together supporters of LGBTQ+ equality to recommit to advancing justice with pride, and to celebrate the contributions of our incredible honorees – trailblazing transgender civil rights attorneys Shannon Minter and Jennifer Levi. Shannon is Legal Director at the National Center for Lesbian Rights, and Jennifer is Senior Director of Transgender and Queer Rights at GLAD Law.

Docket Highlights
Ensuring Military Service Members Can Access Health Care for Transgender Family Members: Doe v. Austin
In Doe v. Austin, GLAD filed suit in federal district court in Maine on behalf of two transgender women who receive healthcare through the United States military’s TRICARE program which provides health care insurance benefits to millions of dependents of servicemembers. Each of our plaintiffs is the daughter of former military personnel who served our country for decades. The case challenged the constitutionality of a federal statute dating to the late 1970s that TRICARE has relied on to categorically bar coverage of gender transition surgeries.
On November 1, the judge issued an opinion that the statute violates the Equal Protection Rights of transgender people who need surgery as medically necessary treatment for gender dysphoria. This is an important decision adding to the precedent that exclusions of health coverage for gender dysphoria are unlawful.
Fighting Discriminatory Bans on Health Care for Transgender People
Florida: Doe v. Ladapo
GLAD Law is challenging a harmful ban on health care for transgender adolescents and first-of-their-kind restrictions on adult access to care. In June of 2024 the U.S. District Court for the Northern District of Florida issued a strong opinion finding the law unconstitutional.
In that ruling and subsequent orders, Judge Hinkle rebuked the State for making “misleading assertions” and said the State was unable to “present evidence of even a single instance of improper provision of care in Florida… [or] a single departure in this state from the widely accepted Endocrine Society and WPATH standards of care…[, or] a single patient who suffered adverse consequences or came to regret care received in this state.” The District Court also recognized the “strong showing” of animus from some legislators in Florida towards transgender individuals.
Unfortunately, the ban was permitted to take effect by the 11th Circuit Court of Appeals while that court considers the State’s appeal of the decision. Our hearing on the State’s appeal is currently scheduled for the week of January 13, 2025.
Alabama: Boe v. Marshall
Our case successfully blocked Alabama’s criminal health care ban for over a year following a robust multi-day hearing in which we presented expert evidence showing the effectiveness, safety and necessity of the care and the harm that comes to transgender adolescents when it is denied.
The law was allowed to take effect after the preliminary injunction was overturned by the 11th Circuit in August 2023. Our petition for rehearing on the PI was denied by the Circuit Court, and we are preparing to file a petition to the U.S. Supreme Court.
At the district court level, we have opposed the State of Alabama’s motion for summary judgment in the case, arguing that it must be allowed to proceed to trial to ensure a factual record of the safety and efficacy of medical care provided under the WPATH and Endocrine Society Standards of Care, harm suffered when care is denied, and the purposeful discrimination against transgender people motivating the ban. Further action in this case is likely to wait for the outcome of U.S. v. Skrmetti at the Supreme Court.
U.S. Supreme Court: U.S. v. Skrmetti
On December 4 the U.S. Supreme Court will hear arguments in U.S. v. Skrmetti, arising out of Tennessee’s ban on medical care for transgender adolescents.
As in both Florida and Alabama, the Tennessee federal district court granted a preliminary injunction that temporarily halted that ban, but it was stayed by the Sixth Circuit. Both the Tennessee plaintiffs and the U.S. Department of Justice, an intervenor in the case, filed a petition asking the Supreme Court to reverse the 6th Circuit’s stay. The Court granted the U.S. petition, to address the question of whether laws banning medical care for transgender adolescents violate equal protection.
GLAD Law and partner civil rights groups filed an amicus brief on September 3, laying out the argument that by banning care to people only because they are transgender, such laws unlawfully discriminate on the basis of sex, under the rationale the Supreme Court itself stated in Bostock v. Challenging Laws Targeting LGBTQ+ Students
School Sports: Tirrell and Turmelle v. Edelblut
School sports are a vital component of public education because of everything students learn from being on teams, like cooperation, self-discipline, leadership, and more. Despite an immense and coordinated advocacy effort by the New Hampshire transgender community, in partnership with GLAD Law and others, the state legislature banned transgender girls from school sports, disregarding the obligation to ensure equal educational opportunities for all students.
Before the law went into effect, GLAD Law filed a lawsuit on behalf of two New Hampshire high school students, Parker Tirrell and Iris Turmelle. In September we secured a preliminary injunction blocking enforcement of the law and allowing Parker and Iris to benefit from the many educational, physical, and social-emotional benefits of participating in school sports. The judge’s order emphasized that the law is clearly discriminatory and that “the stigma and humiliation that comes from such treatment of a child at the hands of the State is substantial and irreparable.”
On November 8, we filed an amended complaint to clarify that the discriminatory ban’s broad sweep violates the rights of all transgender girls in New Hampshire public schools. You can learn more about this case on our website at GLAD.org/ParkerAndIris.
Fighting School Censorship: Meijia v. Edelblut
In May we won a significant victory in federal district court with a ruling finding New Hampshire’s school censorship law unconstitutional. The law actively discouraged public school teachers from teaching and talking about race, gender, sexual orientation, disability, and gender identity inside and outside the classroom. The court found that the law violated the Fourteenth Amendment, concluding the law was so unclear and vague that it failed to provide necessary guidance to educators about what they could and could not include in their courses and that it invited arbitrary and discriminatory enforcement—up to and including the loss of teaching licenses.
The state has filed an intent to appeal to the First Circuit Court of Appeals, and we will continue working to ensure this law is permanently overturned.
Supporting School Policies Providing a Welcoming and Safe Environment: Doe v. Manchester School District
On August 30, the New Hampshire Supreme Court affirmed a lower court ruling upholding a Manchester School District policy in support of transgender students. The policy includes referring to students by their requested names and pronouns and maintaining student privacy when appropriate. GLAD Law filed an amicus brief highlighting the vital educational interests served by schools providing a welcoming and supportive environment for all students, so that all students have an equal and safe opportunity to learn. In its decision the Court concluded that “[T]he plaintiff has failed to demonstrate that the Policy infringes a fundamental parenting right.”
Protecting the Balance Between Religious Liberty and Nondiscrimination
Employment and Health Care Benefits: Bernier v. Turbocam
GLAD Law represents Lillian Bernier, a machinist at a large, private manufacturer of jet-engine parts, in a lawsuit challenging the total exclusion of essential medical coverage by her employer, Turbocam, solely because she is transgender. Turbocam claims that the religious beliefs of the company’s owner are a legal justification for discrimination through its self-funded plan. In June the federal district court denied Turbocam’s motion to dismiss Lillian’s claims, filed under both state and federal nondiscrimination laws. We are now preparing for a trial in 2025.
Schools and Public Funding: St. Dominic Academy, et al. v. Makin
For areas without public high schools, the state of Maine provides state funds to support students’ tuition at a private school elsewhere. In 2022, the U.S. Supreme Court ruled in Carson v. Makin that the program must apply to religious schools including those that provide sectarian education, and Maine revised its program to do so.
However, Maine also requires all schools receiving tuition from public funds to abide by the educational nondiscrimination provisions of the Maine Human Rights Act. While at least one religious school has agreed to follow Maine nondiscrimination law, two other religious schools filed lawsuits in Maine federal district court claiming the application of the Human Rights Act (MHRA) provisions to them violates their free exercise of religion. The District Court denied both challenges, and the schools have appealed to the First Circuit Court of Appeals.
GLAD Law and Lambda Legal joined together on a friend-of-the-court brief to make two broad points: 1. The Carson v. Makin decision about the earlier version of the program does not control in this case, and 2. Maine has compelling state interests in requiring compliance with the MHRA.
No oral argument date has been set.
Protecting Parent-Child Relationships
Glover v. Junior
GLAD Law and partners advocating on behalf of LGBTQ+ families and their children filed a friend-of-the-court brief urging the Pennsylvania Supreme Court to issue a ruling protecting a lesbian mother’s parental status and affirming the recognition of legal parentage for children born through assisted reproduction.
The case concerns a married, non-genetic, non-gestational mother, Nicole Junior, who planned with her now former spouse to conceive and raise a child via assisted reproduction, with the clear intent that both would be the child’s parents. In a December 2023 en banc ruling overturning a prior panel decision, the Pennsylvania Superior Court – citing evidence including that Junior and Glover had jointly signed agreements related to the assisted reproduction – found Junior had established legal parentage of her child and that the couple’s subsequent separation and divorce after conception did not change the fact that Junior is her child’s intended and actual parent.
Our brief urges the state Supreme Court to affirm the Superior Court’s ruling securing Junior’s legal relationship to her child.
Protecting Marriage Equality
From supporting a long shot marriage case in the 80s, to breaking the historic barrier on marriage in the Goodridge Massachusetts case, to the 1st successful DOMA challenge in 2010 and then winning marriage equality at the US Supreme Court in 2015, GLAD Law has been expanding equality & freedoms for LGBTQ people for decades.
Marriage equality has been good for families, for kids, and for society. More marriages have harmed no one, and there is no good reason to disrupt what works. Obergefell was rightly decided and lots of people and entities count on it. It would be outrageous to undo it. We know that our communities and people all over the country are deeply worried about what’s next.
GLAD Law has a dedicated team of lawyers working nationwide on critical issues, including any efforts to limit marriages. We are monitoring for any threat & will defend marriage equality and LGBTQ people’s dignity and humanity across the board.

Supporting Efforts to Mitigate Bias and Systemic Discrimination of Formerly Incarcerated People
In August, we submitted written and oral testimony to Maine’s Criminal Record Review Committee with the intent of informing future legislative efforts. Our testimony highlights considerations and provides resources in support of expanded criminal record sealing. Record sealing and expungement allow people to reintegrate into society and pursue educational and work opportunities without the stigma of a criminal record, making such initiatives essential to eradicating systemic barriers to racial and economic justice.

A Message from the Chief Financial Officer
GLAD Law’s financial health is strong.
We have 12.64 months of unrestricted reserves (i.e., net assets) as of March 31, 2024, including board designated net assets (BDNA). There is sufficient cash and investments to meet our obligations. Our financial health is both intentional and important as we make strategic investments in staff, programs and infrastructure to prepare for increased demands on our legal advocacy and as we face an uncertain economy and climate in FY26 and beyond.
FY24 ended with an increase in net assets of $2.48m. For a non-profit, it is important to look at the components (see table below) and some highlights:

- The unrestricted fund is up $2.3m, in total. Bequest income was higher than expected and we received a grant in March 2024 from a new donor. Based on this and as part of the FY25 budget process the board agreed to invest $500k to increase salaries & wages to 100% of market median so that GLAD Law could remain competitive and retain staff. This investment along with a strategic plan to add more lawyers (4 have been hired so far in FY25) have long-term financial implications.
- Over the next few years GLAD Law will be using reserves to complement an increase in overall fundraising and to fund strategic initiatives. With this backdrop, at the end of FY24, $2.3m was transferred to BDNA for a total of $4m. As a result, a larger portion (67%) of GLAD Law’s unrestricted reserves is designated. We feel this is prudent.
- The donor restricted fund consists of cash gifts and pledges restricted by the donor for a specific purpose or time. This fund increased by $160k, which means new gifts exceeded ‘releases’ in FY24.
During FY24 GLAD Law received donated legal services of $7.8m, an essential resource that supports our litigation.
GLAD Law secured significant foundational support in FY24, led by a $1 million grant from Yield Giving, the philanthropic fund established by MacKenzie Scott. This was followed by substantial grants from the Gill Foundation at $700,000, an Anonymous Foundation at $300,000, and the Klarman Foundation at $150,000. The diverse mix of funders, from major national foundations to regional organizations like the Rhode Island Foundation and The Boston Foundation, reflects the breadth of institutional confidence in GLAD Law’s mission and impact.
There are many challenges and opportunities ahead. Compared to FY24, our base costs over the next few years (excluding in kind) will grow almost 40% from $5.2m to $7.2m. We will continue to invest in staff, programs, communications, and infrastructure and need your partnership to fight the legal battles ahead.
